Vietnam Expands Scope of Compulsory Fire and Explosion Insurance Under Decree 105/2025/NĐ-CP

Vietnam has tightened fire safety regulations under Decree 105/2025/NĐ-CP, which shall take effectiveness since July 1st 2025 and officially replaces Decree 67/2023/NĐ-CP. The new decree lowers the thresholds and significantly broadens the range of properties required to carry mandatory fire and explosion insurance.

Under the now-superseded Decree 67/2023/NĐ-CP, “insured properties” were defined as facilities exposed to fire and explosion risks—such as houses, buildings, machinery, and stored goods—with eligibility criteria often clarified via annexes and guiding documents. These typically focused on volume or height thresholds, especially for residential and mixed-use buildings.

Decree 105/2025/NĐ-CP expands these criteria, applying mandatory coverage to a wider array of properties that were previously excluded. Businesses and property owners should promptly review whether their sites now fall under the revised scope.

The new decree lowers the minimum criteria for mandatory fire and explosion insurance and adds more facility types to the list of properties subject to coverage. This shift marks a more proactive regulatory approach, aiming to increase protection across a wider range of assets. Key changes are summarised in the comparison table below.

Why the Change Now?

Although fire incidents have declined compared to late 2024, the risk remains high—especially in dense urban areas and mixed-use properties that often fall short on fire safety. The Ministry of Public Security has played a central role in pushing for stricter regulations to address these concerns. Through Decree 105/2025/NĐ-CP, the government seeks to raise fire safety awareness and legal responsibility among property owners, while also ensuring stronger financial readiness for post-incident recovery. A key provision requires insurers offering mandatory fire and explosion coverage to contribute 2% of their previous year’s collected premiums to a national fire prevention fund. This fund is intended to boost Vietnam’s overall fire response and prevention capacity.
